The Health Ministry has proposed letting regulators suspend a drug maker's licence for a medicine at once when a government laboratory finds it substandard on key quality checks, instead of waiting for a show-cause process to run its course.

The change is a draft amendment to the Drugs Rules, 1945. It would apply when a Government Analyst's report declares a drug "Not of Standard Quality" (NSQ) on assay, dissolution, related substances, impurities or sterility. The licensing authority, central or state, could then suspend the manufacturing licence for that drug immediately.

Why the ministry wants it

Under existing rules, suspension or cancellation follows a prescribed procedure that includes a show-cause notice. The ministry says this can leave a gap between an NSQ declaration and action, during which the drug may stay in circulation and be harder to recall.

What the draft says

  • Lifting a suspension: the suspension would continue until the manufacturer carries out a root cause analysis and puts corrective and preventive action in place to the licensing authority's satisfaction. It could be revoked only after the authority verifies those measures.
  • Who gets the lab report: under changes to Form 13, the Government Analyst's report would go to the Drugs Controller General of India, the state or UT licensing authority for the manufacturing site, and the manufacturer and marketer of the drug.

The proposals follow the 65th meeting of the Drugs Consultative Committee on 20 December 2024 and the 92nd meeting of the Drugs Technical Advisory Board on 24 April 2025.

What happens next

The draft is open for public consultation. Objections and suggestions can be sent within 30 days of the Gazette copies being made available, to the Under Secretary (Drugs), Health Ministry, Kartavya Bhawan-1, New Delhi 110001, or by email to the address given in the release. The rules are not final until the ministry notifies them.
